By accessing our website or enrolling in any program, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2. Description of Services

We offer the following sleep environment optimization programs, as described on our Rest Kit Lineup page:

• Lumina Sleep Light Audit ($189 AUD): A comprehensive light assessment including circadian-friendly recommendations, dimming schedules, and smart lighting integration guidance for one bedroom.
• HushWave Noise Assessment ($249 AUD): Acoustic mapping, white noise calibration, renter-friendly soundproofing plans, and a four-week habit integration module.
• Complete Rest Environment Program ($449 AUD): Full light, noise, and habit optimization with four weekly check-ins, progress tracking, and a personalized maintenance guide.

Our programs provide educational guidance and environmental recommendations. They are not medical services and do not constitute professional health advice. Individual results may vary based on adherence to program recommendations and personal circumstances.

3. Eligibility

You must be at least eighteen years of age and capable of entering into a legally binding agreement under Australian law to use our website and purchase our programs. By using our services, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and complete.

4. Program Enrollment and Payment

To enroll in a program, you must complete our contact form or speak with a Flourishpure specialist who will confirm your program selection and provide payment instructions. All prices are listed in Australian Dollars (AUD) and include GST where applicable. Payment is due in full before program delivery unless otherwise agreed in writing. We accept major credit cards and bank transfers as communicated during enrollment.

Upon successful payment, you will receive a confirmation email with your program start date, assessment questionnaire link, and specialist contact details. Failure to complete payment within seven days of enrollment confirmation may result in cancellation of your reservation.

5. Program Delivery and Client Responsibilities

Programs are delivered primarily through remote consultation via video call, email, and digital materials. Assessment reports are delivered within five business days of completing your virtual walkthrough. You are responsible for providing accurate information about your sleep environment, participating in scheduled check-ins, and implementing recommended changes at your own pace and discretion.

You agree to attend scheduled consultation calls or provide at least twenty-four hours notice of cancellation. Missed appointments without notice may count against your included check-in allowance. You are responsible for purchasing any recommended products (bulbs, curtains, acoustic materials) from third-party retailers at your own expense unless explicitly included in your program tier.

6. Intellectual Property

All content on flourishpure.world, including text, graphics, logos, program materials, assessment templates, and the generative hero animation, is the property of Flourishpure or its licensors and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.

Upon enrollment, you receive a personal, non-transferable license to use program materials solely for your own sleep environment optimization. You may not share, resell, or publicly distribute assessment reports or program modules.

7. Acceptable Use of the Website

When using our website, you agree not to: use automated systems to scrape or collect data from our site; attempt to gain unauthorized access to our systems or other users' information; upload malicious code or content; impersonate Flourishpure or its representatives; use our website for any unlawful purpose; or interfere with the proper functioning of our website or services.

8. Disclaimers

Our website and programs are provided on an "as is" and "as available" basis. To the fullest extent permitted by Australian Consumer Law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 9. Limitation of Liability

To the maximum extent permitted by law, Flourishpure and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or programs, including loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid for the specific program giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot be lawfully excluded. Where our liability cannot be excluded, it is limited to re-supplying the service or refunding the program fee at our discretion.

10. Indemnification

You agree to indemnify and hold harmless Flourishpure from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of our website or program materials, or your implementation of recommendations in a manner inconsistent with provided guidance.

11. Termination

We may suspend or terminate your access to our website or programs if you breach these Terms, fail to make required payments, or engage in conduct harmful to our business or other clients. Upon termination, your right to access program materials ceases, though provisions regarding intellectual property, limitation of liability, and dispute resolution survive termination.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Victoria, Australia. Any dispute arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty days, disputes shall be submitted to the exclusive jurisdiction of the courts of Victoria, Australia.
